Terms of Service

kant.au is operated by Adrian Hewitt trading as kant.au (ABN 47 985 180 864), a sole trader registered in Tasmania, Australia.
1. Acceptance of Terms
By accessing and using kant.au ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. You must be at least 16 years of age to use the Service. By using the Service, you represent that you are at least 16 years old.
2. Description of Service
kant.au provides web services for monitoring and managing your online presence.
3. Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Ensuring you have the right to use any resources or data you interact with through the Service
- Providing accurate account information
4. Acceptable Use
You agree not to:
- Use the Service in relation to resources or data you are not authorised to access
- Attempt to circumvent usage limits or security measures
- Use the Service for any illegal or harmful purpose
- Interfere with or disrupt the Service or its infrastructure
- Resell or redistribute the Service without authorisation

5. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance that temporarily affects availability. We are not liable for any damages resulting from service interruptions. Nothing in this section excludes or limits any consumer guarantees under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be lawfully excluded.
6. Payment and Billing
Paid plans are billed monthly or annually in advance. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel. All prices are displayed in Australian dollars (AUD) and are inclusive of all applicable taxes. kant.au is not currently registered for GST.
- Prices are subject to change with 30 days notice
- Refunds are available within 14 days of initial purchase
- Downgrades take effect at the next billing cycle
- Unused portion of cancelled subscriptions is not refunded
Nothing in this section limits your rights to a remedy (including a refund) under the Australian Consumer Law where services fail to meet a consumer guarantee.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our data practices as described in the Privacy Policy.
8. Intellectual Property
The Service and its original content, features, and functionality are owned by kant.au and are protected by international copyright, trademark, and other intellectual property laws.
9. Limitation of Liability
To the maximum extent permitted by law, kant.au shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim. Nothing in this section excludes or limits liability for any consumer guarantees under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be lawfully excluded or limited. 10. Changes to Terms
We may modify these terms from time to time. We will provide at least 30 days written notice of material changes via email or through the Service before they take effect. If you do not agree with the updated terms, you may terminate your account before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the new terms.
11. Termination
You may cancel your account at any time through your account settings or by contacting us.
We may suspend or terminate your account for material breach of these terms. Where practicable, we will provide you with 14 days written notice and an opportunity to remedy the breach before termination takes effect.
We may suspend or terminate your account immediately and without notice if:
- Your use of the Service poses a security risk to the Service or other users
- You are engaging in or facilitating illegal activity
- Providing notice would compromise the security or integrity of the Service
- We are required to do so by law
12. Governing Law
These terms are governed by the laws of Tasmania, Australia. Any disputes arising in connection with these terms are subject to the exclusive jurisdiction of the courts of Tasmania, Australia.
13. Dispute Resolution
If a dispute arises in connection with these terms, the parties agree to follow this process before commencing court proceedings:
- Negotiation: The parties will first attempt to resolve the dispute by good-faith negotiation within 14 days of written notice of the dispute.
- Mediation: If negotiation is unsuccessful, the parties will refer the dispute to mediation administered by the Resolution Institute in Hobart, Tasmania. The costs of mediation will be shared equally.
- Court proceedings: If mediation does not resolve the dispute within 30 days of referral, either party may commence court proceedings in the courts of Tasmania, Australia.
Nothing in this section prevents either party from seeking urgent injunctive or interlocutory relief from a court of competent jurisdiction.
